The legal part, in plain words
Terms, data and cookies. Written to be understood on one read, without leaving out what the law requires. The Spanish version is the one that governs.
Terms of service
This is a translation for convenience. LQS operates under Colombian law and the Spanish version is the one that governs. Where the two differ, the Spanish text prevails.
Who we are
This site belongs to LQS (Lo Que Sea), a modular creative agency, run by Caleb Parra Vargas, domiciled in Medellín, Antioquia with an address for notices at Calle 61 #48-7, Medellín. Write to us on WhatsApp at 333 279 1710 or by email at loqueseaproductionsp1@gmail.com.
Using this site means you accept what it says here. If something does not sit right with you, write to us before hiring anything and we will talk it through.
What this site is and is not
It is an informational site. Nothing is sold here. There is no cart, no payment gateway and nothing is charged through this channel. What there is: information about what we do, and two ways to write to us — WhatsApp and email.
The quote builder gives estimates, not offers
This is the most important part of this page, so it goes without detours:
The number that comes out of the quote builder is an estimate calculated on «from» rates. It is not a commercial offer within the meaning of article 845 of the Colombian Commercial Code and it does not bind LQS to anything.
The firm price comes from a written proposal, with the scope defined, which we send you after we talk. If a fault in the site shows a wrong figure, that figure does not bind us either: we correct it and let you know.
The same goes for published rates: they are the ones in force on the date of this page and may change without prior notice. The rate that governs is the one in the proposal we sign, not the one that was on the site the day you looked.
How hiring works
After we talk we send you a written proposal with scope, deliverables, timeline and price. Work starts when you accept that proposal in writing and the first payment is made.
- Payments: 50% up front and 50% on delivery, unless the proposal says otherwise. The Social area is paid in advance with a fixed billing date.
- Revisions: two rounds per delivery, agreed from the brief.
- Timelines: they run from the moment you approve the brief and hand over the material needed. If material arrives late, the date moves by the same amount.
- Rush work: under five business days carries a surcharge, and it is in the proposal.
If we miss the agreed date, we tell you straight away with a new one and you are compensated under the contract. It is not a goodwill gesture: it is written down.
Who owns the work
- Economic rights in the final pieces transfer to the client once payment is complete. Before that, they remain with LQS.
- Moral rights stay with whoever created the piece. In Colombia they are inalienable and cannot be waived (Law 23 of 1982); they cannot be transferred even if both parties want to.
- Working files —editable projects, layers, edit sessions— are not handed over unless agreed and quoted separately. What is delivered are the finished pieces in the agreed formats.
- Rejected proposals and discarded drafts belong to LQS and may not be used.
- We may show the work in our portfolio, on social media and in proposals, unless we agree otherwise in writing. If you need confidentiality, say so before we start and it goes into the contract.
- Material you hand over —logos, photos, text, music, fonts— has to be yours or licensed for the use we are going to give it. If it is not, any claims are yours to answer, and we say that warmly but seriously.
What is on this site
The text, design, code, icons and faces on this site belong to LQS. You may quote them with attribution and a link. You may not copy the site or its parts for another project.
Artificial intelligence
When we use AI in a piece, we say so on the piece. You will never receive something AI-generated without knowing. It is our own rule, older than any legal obligation.
Links to other sites
This site takes you to WhatsApp and to your email, and loads its typefaces from Google. Once you leave here their terms apply, not ours, and we do not control what they do with information.
How far we answer
The site is provided as is. It is hosted on GitHub Pages and we cannot guarantee it will be available without interruption or free of errors. We are not liable for damages arising from using or being unable to use the site itself.
What we do answer for is what we sign: the commitments in a services contract —scope, date, deliverables— are answered for under that contract.
None of the above limits the rights Colombian law grants consumers, which cannot be waived (Law 1480 of 2011).
Requests, complaints and claims
By email at loqueseaproductionsp1@gmail.com or on WhatsApp at 333 279 1710. We answer within fifteen business days at most. If the complaint concerns your personal data, see the deadlines in section 02, which are different.
Governing law
These terms are governed by the laws of the Republic of Colombia. Any dispute is resolved before the competent Colombian courts.
Changes
We may update these terms. The version in force is always the one published here, with its date at the top. If the change is substantive and you are already a client, we tell you.
Personal data policy
Complies with Colombian Law 1581 of 2012 and Decree 1377 of 2013, now compiled into Decree 1074 of 2015. The Spanish version governs.
Who answers for your data
Data controller: Caleb Parra Vargas.
Domicile: Medellín, Antioquia. Address: Calle 61 #48-7, Medellín.
Email: loqueseaproductionsp1@gmail.com. Phone: 333 279 1710.
Handles requests: Caleb Parra Vargas — loqueseaproductionsp1@gmail.com.
What data we ask for
Three things only: your name, an email or a WhatsApp number to reply to you, and whatever you write in the message. Nothing else.
This site does not ask for an ID number, a physical address, a date of birth or financial details. If we end up needing them to invoice or sign a contract, we ask separately and explain what for.
We do not ask for sensitive data —health, ethnic origin, political or sexual orientation, biometric data. You are not obliged to give any. If you write some in the message on your own, we do not use it for anything and we delete it.
This site is not aimed at minors and we do not knowingly collect their data. When a project involves minors —an event, an educational programme— authorisation is signed by whoever holds parental authority, after the minor has been heard, as article 12 of Decree 1377 of 2013 requires.
What we use it for
- To answer your request or your quote.
- To prepare and send you a proposal.
- If you hire us: to carry out the work, coordinate deliveries and invoice.
- To meet accounting, tax and legal obligations.
- To follow up commercially — only if you authorise it, and you can tell us to stop at any time.
We do not sell your data. We do not pass it to third parties for advertising. We do not use it to build profiles. If we ever needed to share it with a supplier to deliver the service, we tell you first and you decide.
Where it actually ends up
It is worth knowing, because almost nobody says it: this site has no database and no server of its own. When you press send, the site composes the message and opens it in your WhatsApp or your email. You are the one who sends it, from your own account.
That means your message ends up where your messages end up: on WhatsApp, operated by Meta, or in email, operated by Google. Those companies store information on servers outside Colombia and have their own privacy policies. That is an international transfer of data and we tell you so you can decide knowing it.
If you would rather use neither, write to the physical address above.
How long we keep it
- Quotes that go nowhere: deleted after a year.
- Clients: for as long as the relationship lasts, and then for as long as commercial and tax rules require records to be kept.
- When you ask for deletion and no legal duty obliges us to keep it, it is deleted.
Your rights
Article 8 of Law 1581 of 2012 gives you these, and they do not depend on our goodwill:
- To know, update and correct your data.
- To request proof of the authorisation you gave.
- To be informed about the use we have made of it.
- To complain to the Superintendence of Industry and Commerce.
- To withdraw authorisation or ask us to delete your data, where no legal or contractual duty prevents it.
- To access your data free of charge.
How you exercise them
Write to loqueseaproductionsp1@gmail.com with the subject «Personal data», tell us what you need and how to reach you. No form and no lawyer needed.
- Queries: we answer within ten business days at most. If we cannot, we tell you why and we have up to five more business days.
- Claims: we answer within fifteen business days at most. If we cannot, we tell you and we have up to eight more business days.
If the claim is incomplete we tell you within the following five days so you can complete it. If two months pass without a reply from you, it is taken as withdrawn.
Before complaining to the Superintendence of Industry and Commerce you must have exhausted this process with us. The law requires it, and it also gives us a chance to fix it.
How we treat your authorisation as valid
Ticking the box on the form authorises the processing. Since there is no server to record it, the authorisation and its date are written inside the message that gets sent. That message is the proof, and you have a copy of it too, in your WhatsApp or your sent folder.
National Database Registry
LQS is not required to register its databases in Colombia's RNBD: that obligation covers controllers with total assets above 100,000 UVT, which is not our case. If that ever changes, we register and say so here.
Term
This policy is in force from 4 de octubre de 2026. Databases are kept for as long as LQS operates and they are necessary for the purposes above. If we change it, we publish the new version here with its date.
Cookie policy
This site uses no cookies. Not session, not analytics, not advertising. None.
What that means concretely
- There is no analytics. No Google Analytics, no Meta pixel, no measurement tool of any kind. We do not know how many people come in or where from.
- There is no advertising and no remarketing. This site will not follow you around the internet.
- We store nothing in your browser. No cookies, no localStorage, no sessionStorage.
- What you pick in the quote builder travels in the page address, not on your device. That is why you can copy the link and send it to someone with the selection inside — and why, when you close the tab, nothing is left behind.
- Your language choice works the same way. English lives on its own pages under
/en/. Nothing is saved to remember it.
That is why you will not see a cookie banner. We are not hiding it and we did not skip it: there is simply nothing to consent to. A window asking permission for nothing would be theatre.
The only third-party request
The site's typefaces are loaded from Google Fonts. That installs no cookies, but it does show Google your IP address and the browser you use, because it is your device that goes and asks for the file.
It is the only connection to a third party this page makes, and it can be removed by hosting the typefaces on the site itself. It is on our to-do list and when it is done, we update this.
When you leave the site
Tapping «Send on WhatsApp» or an email link takes you out of here. From that moment the cookies and policies of WhatsApp, your email provider or your browser apply. We do not control them.
If this changes
If we ever add measurement, we say so here before doing it, with a date, explaining what is measured and what for — and if that measurement collects personal data, we ask for your authorisation, as Law 1581 of 2012 requires.
Colombia has no specific cookie law. When a cookie collects personal data, the general regime of Law 1581 of 2012 applies to it. We say so to be clear about which rule we are under, not to hide behind it.
Does any of this not sit right?
Write to us and we will talk it through before we sign anything. We would rather take an awkward question today than a misunderstanding halfway through a project.
